Terms & Conditions

Registering with The Beach House, with a deposit or full payment of the reservation, confirms acceptance of the terms and conditions set out and shall be binding on the persons listed on the booking form intending  to occupy the premises (or any subsequent amendments to this list). You must be 21 years old to place a reservation and register. Please read all  terms and conditions carefully and sign where noted. ALL GUESTS MUST SIGN THE TERMS AND CONDITIONS at the time of booking. Please understand that your Payment for the Vacation Rental is another form of  your acceptance of the terms and conditions.   

Reservations and Payments

A valid credit card is required for all reservations to secure your  reservation. A 25% deposit is required at the time of your initial  reservation along with registration.    

All guest reservations must have a credit card on file for incidentals - no exceptions. 

Upon receipt of this deposit and registration you will be sent a confirmation of the booking. Payment of the balance is due no later than 30 days prior to your arrival date (or immediately if booked less than 30 days in advance of your arrival). You will receive full details of the reservation, along with directions and key codes within 48hrs of your arrival date. Failure to make the final payment by the due date may result in the loss of the booking and deposit. Reservations are subject to a service fee when amending dates, size or category of room once the reservation has been confirmed. We recommend that all guests ensure they have appropriate holiday, medical, injury, death and cancellation insurance coverage prior to travel.  

We reserve the right to cancel or modify reservations where it appears that a guest has engaged in fraudulent or inappropriate activity or under other circumstances where it appears that the rates or details of the reservation contains or resulted from a mistake or error. Guests departing earlier than their reserved check-out date will not receive a refund. 

Rates  

The rates quoted are based on your period of stay. Rates are subject to  change as a result of changes in your arrival and/or departure dates. The rates are in U.S. dollars. Rates quoted do not include applicable taxes,  amenity or cleaning fees. Rates are subject to change without notice on the website. Confirmed booking rates will never be changed unless directed by the customer ie: the guest chooses to add days to their stay. The rate and rental listing information provided online, though deemed  accurate is not guaranteed. It is subject to errors, omissions, change of  price or withdrawal without notice.  

Rental Unit

The person who registered is responsible for the The Beach House rental and the conduct of all occupants and guests. Only the registered tenant may occupy the rental property; sub-letting is not permitted. Renters must always abide by the maximum persons allowed in each unit. There are no exceptions to this rule. Renters are responsible for daily upkeep of the rental property.The Beach House shall not be liable to guests or to any party for any type of issued violations, including but not limited to: traffic tickets, noise complaints, turtle ordinance violations, etc. The sole responsibility lies on the responsible party including any incurred fees or fines.  

Amenities  

All rooms come fully equipped with television(s), linens, towels, dishes,  glassware, and utensils and an initial supply of soap and paper goods.  Rooms all have hairdryers, iron and ironing boards in the rooms.

Damage  

By booking direct or through one of our OTA’s (not limited to Expedia, Booking.com, Airbnb, Vrbo, or direct), all guests are responsible for any theft or damage done to the rental room/cottage (not limited to bed, mattress, headboard, furniture, or any furnishings or decor in the room). Any damage done by a pet must be paid up to a $500 fine as well as smoking in the room (which is subject to the property manager). By booking with the The Beach House, guest does agree to pay any incidentals that occur during their stay by any guests that are in their party.

Check In and Check Out Time  

Check-in time is between 1:00pm-4:00pm and check-out time is by  10:00am. Guests will use the lockbox to get into their designated room if arriving after the normal check in window. Lockbox codes will be provided 24 hours prior to arrival for all late check ins. All who  check in after hours will officially check in the next morning in the office.  Late check-outs are available on request subject to room availability and occupancy level.  

Smoking  

The Beach House is a non- smoking property (this includes vaporizers). Smoking is prohibited within the suites or anywhere on The Beach House property. Smoking on premises will result in immediate eviction and loss of all rental fees and deposits.

Pet Policy  

The Beach House is not pet friendly. The unauthorized occupancy of pets where prohibited will result intimidate eviction and loss of all rental fees and deposits. Dogs are allowed under certain conditions and ALL animals, including service animals, must be disclosed and approved prior to arrival.  

House Parties/Events

Events may not be held on property, unless booking out the entire complex (13 rentals). If you reserve one of our rooms for a house party (which would be defined as a party of 4 or more without consent of The Beach House), you will not be allowed to check-in and deposit will not be refunded. A house party or event discovered at check in is required to leave without a refund. Weddings, family reunions and other events are not permitted on site unless approved by management. 

Parking

Parking is available for all registered guests.

Jet Skis, Boats, Campers, Trailers Policy  

Jet skis, boats, RV’s, campers and trailers are prohibited on our  property.  

Courtyard & Public Space  

Guests are not permitted to leave any personal items on the balconies, including, but not limited to rafts, beach chairs, coolers, towels (unless on designated towel hooks to dry). Beach chairs can be  stored in designated areas or by front door to room.

Laundry Service  

Bath towels will be changed every 3-4 days upon request. Please  put used towels in basket and place outside your door to be  serviced. The Beach House does have not have a guest washer and dryer on premises.

As a condition of your use of the The Beach House website, you warrant that: 

  • You are at least 21 years of age,  

  • You possess the legal authority to create a binding legal obligation, 

  • You will use this Website in accordance with this Agreement,

  • You will only use this Website to make legitimate reservations for you or for another person for whom you are legally authorized to act.  

Security

The guest is responsible for locking the doors to the extent of locks available at the property before leaving at any time during their stay.    

Complaints  

In the unlikely event of a problem arising during your stay in one of our suites, you should contact us immediately and we will seek to resolve the matter within a reasonable period of time. If the problem has not  been reported to us within 24 hours of the problem arising, we cannot  accept responsibility.  

Accommodation Substitution

Where circumstances arise beyond our control (i.e. fire, hurricane, damage/air conditioning malfunction, sale of unit, etc.), your confirmed  property may be unavailable during your reservation dates. The Beach House reserves the right to substitute your accommodations. We cannot guarantee the exact same room or amenities in this situation, but we will make every effort to provide you with a comparable room and a pleasant vacation experience. The Beach House is not liable for damages or inconvenience in this rare and unusual circumstance.  

Minimum Age

The minimum age for guests to enter into a reservation for a vacation  rental is 21 years of age, unless specifically approved in writing. You agree to provide us with proof of age upon request. Guests under the  minimum age must be accompanied by a parent or legal guardian for the entire duration of the rental. Guests under the age of 21 unaccompanied by a parent or legal guardian will not be permitted to rent or occupy any vacation rental unless. We reserve the right to cancel/terminate or reject  reservations if made under false pretenses. Violations of this policy will result in loss of advance payments and immediate eviction from the vacation rental without refund.  

Maximum Occupancy 

Guest must adhere to the maximum occupancy for each suite. Failure to follow this policy will result in loss of deposit and all monies paid towards the booking, and staff may ask guest to vacate property.  

Cancellation or No-Shows by Guests  

In the event of your party needing to cancel your individual Room reservation, the following conditions will apply: 

  • All deposits are nonrefundable.  

  • Deposits may be used towards a future stay if cancelled 60 days prior to booking.  

  • Please call The Beach House to cancel directly- if you booked through a third party channel, you will need to cancel per the companies policy. 

  • No cash refunds are given.  

In the event of your party needing to cancel multiple room reservations (2 or more), the following conditions will apply:  

  • Cancellation policy for groups is per contract  

  • The 50% deposit fee is non-refundable  

  • Cancellation less than 30 days prior to arrival will result in 100% of the total charge  

  • Group booking fee may be refunded in full.  

**Amendment/Changes to a reservation is subject to a Service Fee Trip Cancellation Insurance

To protect against cancellations caused by certain unforeseen events, such as illness, death, natural disasters, etc., we recommend that guests purchase trip cancellation and interruption protection insurance to assure  refund of deposits paid and reimbursement of other vacation payments. The purchase of travel insurance is recommended to protect your  vacation investment. The Beach House is not held liable for Acts of  Nature or any occurrence beyond our control. Travel Insurance that covers trip interruption (trip insurance) is OPTIONAL, however, we strongly recommend it as all monies paid including deposits, advanced rental payments and final payments are NON REFUNDABLE. 

Written Notice Required for Cancellations:  

Guests who purchase travel insurance through CSA Travel or any other insurance provider, VRBO, or any other travel partner will be provided refunds for cancellation subject to the terms and conditions of the travel insurance policy they chose. It is strictly the customer’s responsibility to ensure that the coverage terms are acceptable. If customer elects to decline this coverage, they do so fully understanding our cancellation policy. Acts of God/Hurricanes/Weather/Nature/Pandemic

In the event of an Act of God such as adverse weather, tornadoes, fire,  lightning strikes, or otherwise, The Beach House, is not responsible for any refunds from monies which have been paid to The Beach House, or for providing lodging elsewhere. In the event of mandatory or voluntary evacuation, or a travel advisory, refunds are not issued. We strongly advise you to purchase the appropriate Travel/Trip Insurance to protect your investment and ensure suitable coverage from the insurance  you purchase. If a hurricane threatens the area, and a voluntary or mandatory evacuation is issued, our office will close, and all guests will be required to leave the island. Items left are not the responsibility of The Beach House.  

Cancellation by The Beach House  

In the unlikely event that circumstances necessitate cancellation of the booking, we will seek to relocate your booking to a room of a similar standard. However, if we are unable to find a suitable relocation, we will refund any monies paid (without interest, compensation or consequential loss of any kind).  

Disputes

I understand that if there are ANY disputes or dissatisfaction regarding the vacation rental property paid herein, that said dispute should be taken up directly with The Beach House. I agree that I will not request a chargeback or credit to my credit card in connection with any charge made pursuant to this agreement. I hereby expressly waive my rights to request any chargeback against The Beach House now, and in the future. All complaints must be reported during the customer’s stay and not after departing the property.  

Force Majeure

The Beach House, the owners and their agents accept no responsibility or liability for any loss or damage or alterations to the terms of this booking caused by events beyond their control including, but not restricted to, hurricanes, war, civil commotion, flight  delays or cancellations, technical difficulties with transportation, alteration  or cancellation of schedules by carriers, adverse weather conditions, fire, flood, or any other event beyond their control. We recommend that all guests ensure they have appropriate holiday, medical, injury and cancellation insurance cover prior to travel. See our recommended travel insurance.  

Accidents, Injury or Loss

Special risks may be involved when using rental equipment such as beach chairs, umbrellas, etc, or outdoor equipment (bikes, paddleboards, kayaks, etc) and customer assumes all responsibility for himself/herself and their guests and for the consequences of those at risk. Customer agrees to waive any claim whatsoever and hold harmless The Beach House for accidents and claims resulting from accidents and or injury arising from use of the  rental property and any of its equipment, porches, decks, stairs, parking  area, etc. The Beach House is not responsible for accidents, injury, death, or loss of personal belongings of any kind. Guests shall indemnify and hold harmless The Beach House from any and against all liabilities, claims, expenses, fees, loss of use of actions of any kind arising out of renters or their guests use and occupancy of the premises. Neither the owners nor the management company accept any responsibility whatsoever for personal injury, accidents, loss or damage to persons or personal effects, however caused.  

Illegal Activity

Should any guest or other occupants of the vacation rental use the property for any illegal or unlawful purpose including, but not limited to  the possession, serving, or consumption of alcoholic beverages by  persons less than 21 years of age, house parties or keg parties, beer pong, any disturbance resulting in neighborhood complaints or police  action, or use of the home in a manner contrary to the provisions of this agreement shall be terminated immediately, guests and all other occupants will be required to vacate the vacation rental and all monies paid will be forfeited.

IF BEACH HOUSE STAFF OR LAW ENFORCEMENT IS  DISPATCHED TO A ROOM DUE TO ANY ILLEGAL  ACTIVITY OR DISTURBANCES EMANATING FROM THE VACATION  RENTAL OR GROUNDS, THERE WILL BE A MINIMUM $500 CHARGE TO  TENANT’S CREDIT CARD AND IS GROUNDS FOR TENANT'S IMMEDIATE EVICTION.  

By reserving this property and therefore agreeing to this agreement you give The Beach House the permission to send you ongoing marketing, promotional, and special discount type communications. These are offered various times of the year, and are a benefit to the guest. These can be unsubscribed from if so desired.
